RE:                        Request to Place Emergency Measures on the Agenda for the September 17, 2019 Additional Legislative Meeting

 

This is a request that the following measures be placed on the agenda for the September 17, 2019 Additional Legislative Meeting:

 

  • Commission on the Arts and Humanities Budget Subtitle Technical Emergency Declaration Resolution of 2019

 

  • Commission on the Arts and Humanities Budget Subtitle Technical Emergency Amendment Act of 2019

 

  • Commission on the Arts and Humanities Budget Subtitle Technical Temporary Amendment Act of 2019

 

The introduced version of the Fiscal Year 2020 Budget Support Emergency Act of 2019 (D.C. Act 23-91) included an applicability provision for the Commission on the Arts and Humanities Independence and Funding Restructuring Act subtitle (CAH subtitle).  The provision provided that the CAH subtitle would become effective on the date D.C. Act 23-91 was enacted which was on July 22, 2019.  The Council approved the introduced version of D.C. Act 23-91 on June 25, 2019 with the applicability provision included, but the enrolled version that was signed by the Mayor inadvertently left out the provision.   

 

The underlying legislation restores the applicability provision and provides that the CAH subtitle will apply retroactively as of July 22, 2019.  This technical amendment is necessary to clarify that the Commission on the Arts and Humanities began operating as an independent agency of the District government on July 22nd which was the intent of the Council when it approved the CAH subtitle.
