RE:           Amendment in the Nature of a Substitute for the April 6, 2021 Legislative Meeting

 

This memo is to request that the following Amendments in the Nature of a Substitute be placed on the agenda for the April 6, 2021 Legislative Meeting:

 

§  ANS to the “Non-Public Student Educational Continuity Congressional Review Emergency Declaration Resolution of 2021” (to be renamed the “Non-Public Student Educational Continuity and Homeland Security Fusion Center and Law Enforcement Authority Congressional Review Emergency Declaration Resolution of 2021”)

§  ANS to the “Non-Public Student Educational Continuity Congressional Review Emergency Amendment Act of 2021” (to be renamed the “Non-Public Student Educational Continuity and Homeland Security Fusion Center and Law Enforcement Authority Congressional Review Emergency Amendment Act of 2021”)

 

            D.C. Act 24-2, the Homeland Security Fusion Center and Law Enforcement Authority Emergency Amendment Act of 2021, will expire April 14, 2021.  Although identical temporary legislation was approved by the Council in March (D.C. Act 24-39), its congressional review is pending.  A congressional review emergency is necessary to prevent a gap in legislative authority. 

 

            However, a congressional review emergency was not noticed by my office as the mover of the original emergency and temporary act, or by the Committee on the Judiciary and Public Safety that has jurisdiction over the matter.  Instead, the attached Amendments in the Nature of a Substitute would amend the timely noticed congressional review emergency resolution and act to include the provisions of the expiring fusion center emergency to prevent a gap in the law for both acts.
