RE:           Request to Agendize Emergency Measures for the June 15, 2021 Legislative Meeting

 

The following measures are placed on the agenda for the June 15, 2021 Legislative Meeting:

 

§  PR 24-262, “Fidelity in Compliance of Contracting and Procurement Declaration Resolution of 2021”

§  Bill 24-263, “Fidelity in Compliance of Contracting and Procurement Emergency Amendment Act of 2021”

§  Bill 24-264, “Fidelity in Compliance of Contracting and Procurement Temporary Amendment Act of 2021”

 

            These measures would require compliance with contracting and procurement law as ordered by the Contract Appeals Board and to mitigate the impact and disruption to District residents because of non-timely or noncompliance of ordered reevaluations.

 

            On December 1, 2020, the Contract Appeals Board ruled that the District violated procurement law with respect to the District’s Medicaid Contract, and Ordered the District to re-evaluate the competitive range offerors’ proposals in accordance with District procurement law and regulation. The Order specifies that the District “shall not exercise any option year under that contract such that said contract shall expire on its own terms at the conclusion of the base contract year on September 30, 2021.
