All-
Please see attached an updated DRAFT of what we intend to move on Tuesday. In addition to the Eviction and Utility provisions circulated on Tuesday, this version would remove most of the triggering provisions in the Coronavirus Support Temporary Act to set a date certain rather than tying the provision to the Mayor’s declaration of a public health emergency. The current Temporary runs through approximately February 4, 2022. This approach would give the Council time to reassess the various provisions as the public health emergency winds down. In general, most provisions that would have gone away with the Mayor’s ending of the PHE would be extended until November 5, 2021. This draft would allow the Mayor to continue the public emergency but not the public health emergency (however all of our provisions are triggered on the PHE).
Again, this is a DRAFT. We are cleaning it up with the Office of the General Counsel and still looking at provisions before we file on Monday. We wanted to circulate today so that Members and Staff have the opportunity to go through the draft.
