RE: Emergency Legislation for the July 20, 2021 Legislative Meeting

The following measures are placed on the agenda for the July 20, 2021 Legislative Meeting:

▪ Recess Reprogramming Emergency Declaration Resolution of 2021

▪ Recess Reprogramming Emergency Amendment Act of 2021

▪ Recess Reprogramming Temporary Amendment Act of 2021

On July 13, 2021, the Council adopted changes to its rules regarding transmittal of contracts, reprogrammings, and grant budget modifications during the Council recess. It has come to the Council’s attention that a clarifying conforming change is necessary to the Code to allow reprogramming transmittals during the Council Recess. Without this legislation, it is unclear whether reprogrammings could be transmitted during the recess. This legislation is related to the COVID-19 pandemic in that the Executive has indicated a need to submit reprogrammings to the Council during recess as a result of federal pandemic relief funds being sent to the District.

I expect that additional provisions will be added to this legislation prior to filing on Monday. Negotiations are ongoing with respect to the Executive’s desire to transmit reprogrammings and grant budget modifications throughout the Council Recess. This legislation will serve as the vehicle to enact any changes to the Code that are necessary to effectuate the result of those negotiations.
