RE:           Request to Place Emergency Measures on the Agenda for the December 18, 2018 Legislative Meeting

 

                               

               The following measures are placed on the agenda for the December 18, 2018 Additional Legislative Meeting, at the request of the Mayor:

 

§  PR 22-1152, Modification No. 3 to Contract No. CW59871 with Public Performance Management LLC Approval and Payment Authorization Emergency Declaration Resolution of 2018

§  Bill 22-1051, Modification No. 3 to Contract No. CW59871 with Public Performance Management LLC Approval and Payment Authorization Emergency Act of 2018

 

               These measures would approve a modification to increase budget authority for an existing D.C. Supply Schedule contract with Public Performance Management, LLC, to provide information technology equipment, professional services, and software.  The modification to the base year and option periods would raise the contract maximum ceiling from $950,000 to $10,000,000 to allow additional purchases against the contract.  The increase is to the maximum amount of orders that can be ordered from the vendor but is not a commitment to spend up to the ceiling.  Actual spending is subject to individual agencies’ purchases from the Supply Schedule.

 

               This contract represents what is commonly referred to as a “tipping” contract which requires retroactive Council approval due to modifications raising the ceiling to over $1 million in the current option period subsequent to the commencement of the option period.  The emergency declaration and emergency bill were filed by the Mayor with the Secretary on November 28, 2018.  The base period of the contract began on April 26, 2018.  According to the Council Contract Summary, there has been no spending in excess of the original contract ceiling.
