Emergency Legislation for the July 20, 2021 Legislative Meeting (Revised FY21)

Please see attached the filed versions of the Reprogramming Emergency Act that was noticed last Thursday.  There are two additions to the bill that are pandemic related. 

 

First, the Committee on Labor and Workforce Development requested a change to the work search requirements of the pandemic Unemployment Insurance provision in the Coronavirus Temporary Act that does not have a cost.  Second, we identified and additional provision of law that was tied to the pandemic but was adopted as standalone legislation and is set to expire.  The Public Space Maintenance Temporary Amendment Act of 2020, effective December 23, 2020 (D.C. Law 23-175; 67 DCR 13238) (“Public Space Temporary”), and a clarifying amendment to the Public Space Temporary, the Public Space Maintenance and Arts Clarification Temporary Amendment Act of 2020, effective March 16, 2021 (D.C. Law 23-262; 68 DCR 1186), will expire on August 4, 2021.  The Public Space Temporary authorized the Mayor to enter into an agreement with a Business Improvement District corporation for the maintenance and improvement of public space and was limited to the COVID-19 pandemic.  The attached emergency is essentially a new round of emergency and temporary legislation that will add this provision to the overall Coronavirus Temporary Act.

RE:           Emergency Legislation for the July 20, 2021 Legislative Meeting

 

                               

               The following measures are placed the July 20, 2021 additional legislative meeting:

 

§  Fiscal Year 2021 Revised Local Budget Second COVID Relief Emergency Declaration Resolution of 2021

§  Fiscal Year 2021 Revised Local Budget Second COVID Relief Emergency Act of 2021

§  Fiscal Year 2021 Revised Local Budget Second COVID Relief Temporary Act of 2021

 

               The measures listed above were introduced at the request of the Mayor on July 14, 2021 to support the Fiscal Year 2022 budget package of legislation.  The primary purpose is to allow the nearly-depleted contingency reserve to be refilled.

 

               Since the time the Fiscal Year 2021 budget and financial plan was adopted last year, the federal government has appropriated approximately $2.8 billion in COVID public health emergency relief funds as federal payments to the District of Columbia.  Adjustments to Fiscal Year 2021 budget are necessary to recognize this additional federal resource and to respond to the public health emergency and its negative economic impact on District residents and businesses. 

 

              

               Please note that I may move an Amendment in the Nature of a Substitute (ANS) for each of these items at next week’s meeting; the ANS versions would circulate on Monday, July 19, 2021.  In that case, the Office of the Budget Director will circulate a list of the proposed changes.

 

               Also, as members know, July 20th is when the Council will consider and vote on the Local Budget Act and other budget-related measures.  Because they will first be marked up by the Committee of the Whole, no notice of intent is required today.
