RE:          Request to Agendize for the February 7, 2023 Legislative Meeting

 

 

This memorandum is to request that the following measures, at the request of the Attorney General, be placed on the agenda for the February 7, 2023 Legislative Meeting:

 

        Contract No. DCCB-2023-F-0002 with Edelson PC Approval and Payment Authorization Emergency Declaration Resolution of 2023

        Contract No. DCCB-2023-F-0002 with Edelson PC Approval and Payment Authorization Emergency Act of 2023

 

            The Office of the Attorney General proposes to enter into a multi-year contract with Edelson PC to assist with complex litigation matters related to a consumer protection case against Google, LLC for violating the District’s Consumer Protection Procedures Act.  The contract has a multi-year base period of five years, with two two-year option periods.  The not-to-exceed amount for the five-year base is $55 million.  However, under the terms of the contract, Edelson is entitled to 20% of any monetary award related to the lawsuit from Google, plus reimbursable costs.

 

            OAG entered into the contract on October 6, 2022, therefore retroactive approval of the contract is necessary.  In addition, the contract is multi-year which also requires active approval by the Council.  Already, OAG with Edelson’s assistance negotiated a $9.5 million settlement with Google.
