RE:                  Request to Place Measures on the Agenda for January 9, 2024 Legislative Meeting

 

            This memorandum is to request that the following measures be placed on the agenda for the January 9th, 2024 Legislative Meeting:

 

§  Term Clarification Emergency Declaration Resolution of 2024

§  Term Clarification Emergency Amendment Act of 2024

 

The purpose of this legislation is to immediately implement Bill 25-342, the Term Clarification Amendment Act of 2023 on an emergency basis. The legislation was originally introduced at the request of the Public Charter School Board to clarify that a member of its board, Mr. Jim Sandman, could serve an additional full term if the Mayor chooses to renominate him. Mr. Sandman’s term currently expires on February 24th, 2024, before Bill 25-342 will take effect due to congressional review.

 

The Committee of the Whole expanded the scope of the underlying permanent legislation to effect other changes to laws regarding nominations and appointments.  Importantly, the legislation makes changes to the Administrative Procedure Act and the District of Columbia Codification Act of 1975 to clarify that publication in the D.C. Register is not a prerequisite to legislation becoming effective.  It is desirable that this, too, becomes effective as soon as possible, since it reflects current practice.
